WHEREAS, City and Owners wish to enter into a long-term <br />agreement in order to achieve the benefits of the proposed Project <br />to City and its residents while maintaining conformity with the <br />City's General Plan growth policies; <br /> <br /> WHEREAS, by the terms of the 1972 Settlement Agreement, The <br />Stoneson Development Corporation, as described in Exhibit B, attached <br />to this agreement and made a part of it by reference, was allocated <br />one thousand two hundred and seventy (1270) D.U.E.s (single family or <br />comdominium sewer connection permits referred to hereafter as "Permits"). <br />The Stoneson Development Corporation has designated seventy (70) Permits <br /> <br />to the Nine Acre Parcel (PM2509, Parcel D). Of those seventy Permits, <br />eighteen (18) Permits were transferred from Tract 4588 (the Thirteen <br />Acre Parcel) and 52 Permits were transferred from Tract 2896 (Ten- <br />tative Map referenced in the 1972 Settlement Agreement). The Stoneson <br />Development Corporation now has one hundred fifty-eight (158) Permits <br /> <br />remaining on the Thirteen Acre Parcel. The current status of other <br />Permits allocated by the 19/2 Settlement Agreement to The Stoneson <br />Development Corporation is as follows: Two Hundred Twenty-Nine Permits <br />were designated for Tract 3150 (Stoneridge Townhouses) and eighty-five <br />(85) of those Permits remain to be used. Six Hundred Twenty-Seven <br />(627) Permits remain with Tract Map 2896, which has since been sub- <br />divided by Parcel Map 3701 (Parcels A, B and C). The Stoneson <br />Development Corporation has allocated two hundred forty (240) Permits <br />to Parcel C of PM3701 and three hundred eighty-seven (387) Permits to <br /> <br />Parcel A and B of PM3701. <br /> <br />-2- <br /> <br /> <br />
