9.20.83 <br />C169-323 <br />AG92 <br /> <br /> H. Valley is aware that environmental assessment <br />and adoption of mitigation measures as appropriate will be <br />required by the City prior to PUC approval of the <br /> <br />construction of the at-grade crossings. <br /> <br /> I. The parties contemplate that either an <br />Addendum to this agreement or a separate agreement shall be <br />necessary prior to Valley's advancing money for actual <br />construction of the at-grade crossings. <br /> <br /> The parties hereby agree as follows: <br /> <br /> 1. Reimbursement. Valley agrees to reimburse <br />City for up to Thirty Thousand and no/100ths Dollars <br />($30,000.00) in costs to be incurred in order to prepare and <br />process a PUC application seeking approval for the <br />construction of the at-grade crossings on Valley Avenue near <br /> <br />Stanley Boulevard and Busch Road. <br /> <br /> 2. Procedure for Payment. <br />Valley by invoice for reimbursement <br /> <br /> City shall bill <br />on a periodic basis of <br /> <br />City incurred costs and expenses for which City is entitled <br />to reimbursemnt from Valley pursuant to this agreement. <br />Payments by Valley to City of amounts for which City is <br /> <br />entitled to reimbursement pursuant to this agreement shall <br />be due and payable to City thirty (30) days from the date of <br />invoice. <br /> <br /> 3. Assessment District. The parties shall <br />cooperate with each other to cause the Valley Avenue <br />Extension Improvement District to be formed as soon <br />as reasonably practicable to assure the financing of <br /> <br />-3- <br /> <br /> <br />
