If there should be a hold-over of the facility <br />for the month of April or a portion of April in <br />accordance with the lease terms and conditions <br />the monthly rental fee would be $1,800.00, or a <br />prorated portion for the time City has possession. <br /> <br />For the period of December 1 through December <br />31, 1983, and December 1 through December 31, 1984, <br />the monthly rental fee shall be NINE HUNDRED AND <br />NO/100THS DOLLARS ($900.00). <br /> <br /> 4. Lessee shall pay Lessor monthly for the cost of all <br />utilities including water, gas, heat, electricity and power which <br />may be furnished to or used on or about the premises during the <br />term of this Lease. It is understood that said sums may vary <br />from month to month depending upon usage. Lessee further agrees <br />to pay the costs of replacing nets, center straps, back-drops, <br />broken, lost or stolen light fixtures; any windows broken; as well <br />as the costs of the necessary supplies to the restroom facilities. <br /> <br /> 5. Lessor agrees that Lessee shall have exclusive use of the <br />Young California Building and parking areas delineated on Attachment <br />A for the term of this Lease. <br /> <br /> 6. Should Lessee holdover said premises after the Lease <br />has terminated in any manner, such holding over shall be deemed <br />merely a tenancy from month to month on the same terms and conditions <br />as herein provided. However, Lessee expressly agrees that Lessee <br />shall have no right'to use the premises during the months of June <br />and July. <br /> <br /> 7. Lessee shall, at Lessee's own expense, have and maintain <br />for the purpose of and during the full term of this Lease, in full <br />force and effect, insurance policies, with insurance carriers duly <br />and regularly licensed to transact business in the State of California <br />in the following forms, manner and amounts: <br /> <br /> A. I~rkers' compensation insurance to cover the <br />liability of Lessee in accordance with the provisions <br />of Division 4 of the Labor Code of the State of California' <br />and any and all acts mandatory thereof. <br /> <br /> B. Lessee acknowledges that it will maintain at its <br />own expense, liability insurance not less than five(5) <br />million dollars but that lessee is self-insured for all <br />injuries in an amount up to $50,000. The City of <br />Pleasanton is certified by the State of California to <br />be self-insured for liability purposes. <br /> <br /> 8. The premises are hereby leased to Lessee upon the <br />expres~ condition that Lessee shall use said premises as a tennis <br />and recreational facility.
