uses except upon giving one-week notice to the Lessor with such <br />other uses to be subject to the approval of Lessor. Lessee <br />agrees that no goods, merchandise or materials of a hazardous <br />nature shall be kept, stored, or sold in said premises. <br /> <br /> 9. Lessee shall have the exclusive rights for tennis <br />courts on the Fairgrounds during the term of this Lease period. <br /> <br /> 10~ Lessor shall prepare the interior of the Young <br />California Building for use as a tennis facility prior to Lessee <br />taking possession of said premises with such preparation made by <br />the Lessor to include standardized tennis nets and necessary <br />materials for back nets for each court of which there shall be <br />four (4) indoor tennis courts, and suitable off-court floor area. <br />Lessee shall accept the floor surface in an "as is" condition. <br />However, Lessee will be released from the lease obligation with no <br />penalty if, prior to each season of use x~hen the facility floor is <br />available for inspection, it is determined by the Lessee that the <br />floor condition is such as to be considered not suitable for tennis <br />play. Lessor will notify the Lessee when the floor is available <br />for inspection. <br /> <br /> 11o Lessee is hereby allowed ingress and egress to the <br />demised premises through the Gate commonly known and referred to <br />as Gate #2 as specified on the plot plan attached (Attachment A). <br /> <br /> 12. In addition to the parking area set aside for normal <br />use (see plot plan Attac~ent A), the Lessor shall provide at no <br />additional cost to Lessee all necessary additional parking during <br />tennis tournaments sponsored by Lessee, subject to approval of <br />the Lessor, provided Lessee (a) notified Lessor or his assignee <br />of the proposed tournament at least thirty (30) days prior to the <br />event, (b) the additional parking will not interfere with any <br />previously scheduled event at the Fairgrounds, and (c) Lessee <br />agrees to provide necessary emDloyees to insure parking is under- <br />taken in a proper and safe manner. <br /> <br /> 13. Lessee shall provide for maintenance and supervision <br />of the tennis facility in a safe and proper manner and provide all <br />necessary police protection. <br /> <br /> 14. Lessee 'is hereby granted the right to operate food <br />and beverage concessions, except alcoholic beverages, within the <br />tennis facility and to sell tennis sundries and supplies. Food <br />and beverage concession must be operated in a safe and sanitary <br />manner, subject to all requirements of the County and City health <br />departments. Lessor reserves the right to inspect and sample the <br />food and beverage services and if, in Lessor's'opinion, unhealthy <br />or unwholesome food has been or is being d~spensed, it may <br />terminate after forty-eight (48) hours ~Titten notice, Lessee's <br />right to sell foods and beverages. <br /> <br /> <br />
