Capacity assigned to the Assignee by Prudential pursuant <br /> to Section 10(b), as evidenced by an Assignment of <br /> Sewage Capacity and a Memorandum of Assignment. <br /> <br /> (b) Allocation of Capacity to Different Prop- <br /> erty. City shall not allocate sewage capacity to an <br /> Assignee to be used for any real property other than the <br /> real property to which Prudential assigned the amount of <br /> the Existing Prudential Capacity. <br /> <br /> 12. Existing Prudential Capacity Subject to Plea- <br />santon Sewerage Code. <br /> <br /> (a) Pleasanton Sewerage Code. The Existing <br /> Prudential Capacity whether used by Prudential or an <br /> Assignee, shall be subject to the terms of the Pleasan- <br /> ton sewerage code, as amended from time to time ("Plea- <br /> santon Sewerage Code"). The obligations of Prudential <br /> or an Assignee under the Pleasanton Sewerage Code may <br /> include payment of fees in connection with applications <br /> for building and sewer permits and payment of any <br /> charges related thereto except as has been provided for <br /> specifically herein. <br /> <br /> (b) Excess Discharges. The Pleasanton Sewer <br /> Code may provide for monitoring of the sewage discharges <br /> into the City sewers by the users of the City sewers. <br /> If, in violation of the Pleasanton Sewerage Code, <br /> Prudential or an Assignee discharges into City sewers an <br /> amount in excess of the amount allocated to Prudential <br /> <br />K234-20-A/Sep08 <br /> <br /> <br />
