or the Assignee by City, for a particular premises, City <br /> shall have all enforcement rights set forth in the <br /> Pleasanton Sewerage Code, but City shall not have the <br /> right to reduce the Existing Prudential Capacity by the <br /> amount of the excess. <br /> <br /> 13. Right of Assignee to Enforce. Upon assignment <br />by Prudential of any portion of the Existing Prudential <br />Capacity, Assignee shall have the right to enforce the obli- <br />gations of City under this Second Amended Agreement to the <br />extent such obligations directly relate to the portion of <br />the Prudential Property which is transferred to Assignee and <br />to the portion of the Existing Prudential Capacity which is <br />assigned. <br /> <br /> 14. Termination of Existing Prudential Capacity. <br />Any portion of the Existing Prudential Capacity which has <br />not been allocated by City to Prudential or to one (1) or <br />more Assignees as of December 31, 1995, shall terminate. <br />Upon termination, neither Prudential nor its Assignees shall <br />have any right to use or assign the portion of the Existing <br />Prudential Capacity which has terminated and City shall have <br />the right to allocate the terminated portio~ of the Existing <br />Prudential Capacity in City's sole discretion. <br /> <br /> 15. Application For Additional Capacity.
