particular, Prudential desires that the Pacific Telephone <br />Capacity portion of the Existing Prudential Capacity be used <br />for the Pacific Telephone Property, and the remainder of the <br />Existing Prudential Capacity be utilized for the Prudential <br />Property. <br /> <br /> Q. CPP desires that the CPP Property be freed <br />from any restrictions contained in the Amended Agreement im- <br />posed upon the ability of any owner or lessee of any portion <br />of the CPP Property to seek sewer capacity from City on a <br />first-come, first-served basis or pursuant to the regula- <br />tions and requirements of the City existing at the time of <br />application for capacity. <br /> <br /> ~. Prudential will be entitled to use, or assign, <br />all the Existing Prudential Capacity upon completion of con- <br />struction of the DSRSD-LAVWMA Expansions which is antici- <br />pated to occur within one (1) month from the date of this <br />Second Amended Agreement. <br /> <br /> S.
