requirements of the Hacienda Business Park. It is estimated <br />that, approximately Three Million Seven Hundred Thousand <br />(3,700,000) gallons average day dry weather flow of addi- <br />tional sewage capacity will be required for development of <br />the Hacienda Business Park. <br /> <br /> U. Prudential and CPP further desire City to take <br />the initiative and use good faith efforts to obtain, by <br />acquisition or construction, additional sewage capacity for <br />the benefit of Prudential, CPP and other persons discharging <br />sewage into the City sewers. City efforts may include good <br />faith efforts to obtain all governmental approvals which are <br />required of all governmental authorities to obtain addi- <br />tional sewage capacity. To assist in expanding the sewage <br />capacity presently available to City, Prudential desires to <br />fund the expenses relating to City obtaining the additional <br />sewage capacity subject to a future agreement between City <br />and Prudential regarding reimbursement to Prudential by <br />those, other than Prudential or Assignees (as defined in <br />Subsection l(d)), making use of the additional sewage <br />capacity. <br /> <br /> V. City, Prudential, and CPP desire to enter this <br />Second Amended Agreement because (i) many of the obligations <br />contained in the Amended Agreement have been satisfied, <br />(ii) the boundaries of the Hacienda Business Park have <br />changed with lots created inconsistent with the prior boun- <br />daries of the property subject to the Amended Agreement, <br /> <br />K234-20-A/Sep08 <br /> <br /> <br />
