5. Extra Work: For the purpose of this Agreement, Extra <br />Work means the following professional services. <br /> <br />a. Testimony in court, if requested by the CITY. <br />B. Additional unforeseen office work determined to <br />be necessary by CITY to complete the project, including <br />coordination with Fire Department officials, design architect <br />and property owners after public hearing anticipated to occur <br />prior to December 31, 1983. CONSULTING ENGINEER shall furnish <br />all of the said Extra Work to the satisfaction of CITY'S <br />Director of Public Works with all reasonable diligence. <br />CONSULTING ENGINEER shall perform such Extra Work upon CITY'S <br />written request, specifying the details thereof and the time <br />and manner in which such work shall be performed. <br /> <br /> 6. Fee Adjustment: It is anticipated that portions of <br />Maximum Fee "A" may require work beyond July 1984. After July <br />1984, maximum fees for portions incomplete will be increased <br />on an annual basis by the same percentage increase as the San <br />Francisco Bay Area Consumer Price Index for ~ban Wage Earners <br />using February 1983 as a base year. <br /> <br /> 7. CITY Project Director: The Director of Public Works <br />of CITY shall be the CITY Project Director and shall represent <br />CITY and render overall supervision of the progress and <br />execution of this Agreement. All services to be performed <br />hereunder by CONSULTING ENGINEER shall be subject to approval <br />and acceptance of CITY Project Director, and no payments shall <br />be made by CITY to CONSULTING ENGINEER until said acceptance <br />and approval. <br /> <br /> <br />
