In the judgement of the City Council of the CITY, it is <br /> necessary and advisable to employ the services of CONSULTING <br /> ENGINEER for the purpose of providing engineering services in <br /> connection with the proposed water system improvements program <br /> <br /> entitled "North Pleasanton Improvement District, Project AD <br />1982-6." <br /> <br /> CONSULTING ENGINEER is willing and able to provide said <br />services. <br /> <br />THEREFORE, in consideration of the recitals and the <br /> CITY and MARK THOMAS & CO. <br /> <br /> NOW, <br /> <br />mutual promises contained herein, <br /> <br />INC. agree as follows: <br /> <br /> 1. Employment of CONSULTING ENGINEER: CITY agrees <br />to employ CONSULTING ENGINEER and CONSULTING ENGINEER agrees <br />to perform engineering services for CITY in accordance with <br />the provisions hereinafter contained in this Agreement. <br /> <br /> 2. Duties of CONSULTING ENGINEER: CONSULTING <br />ENGINEER agrees to prepare assessment district engineer's <br />reports and plans and specifications adequate and sufficient <br />for the construction of roadway improvements made a part of <br />the "North Pleasanton Fire Protection District, Project AD," <br />both as currently comtemplated and as may be added to in the <br />future, as directed by CITY'S Director of Public Works. Said <br />duties shall be those more specifically detailed in this <br />agreement as well as such other duties, in conjunction with <br />the projects, as directed by the Director of Public Works.
