- 6 - <br /> <br /> B. Upon acceptance of construction by both agencies, the ownership of <br />the electrical service, behind the meter, to Well No. 4 shall rest with ZONE 7. <br /> <br /> C. Upon acceptance of construction by both agencies the ownership of all <br />improvements other than those mentioned under III.A. and III.B. shall rest with <br />CITY provided that CITY thereby permits ZONE 7 to use the service road, under <br />Paragraph I.E. above, upon its completion. <br /> <br />IV. Maintenance <br /> <br /> Upon acceptance of construction by both parties, maintenance of improvements <br />and liability exposure shall rest with the owner. <br /> <br />V. Mutual Cooperation <br /> <br /> ZONE 7 and CITY shall cooperate to effect all phases of construction of the <br />Project. Such cooperation shall include mutually agreeing to such modifications <br />to the Project as are found reasonable and desirable upon completing final <br />plans and undertaking construction. <br /> <br />VI. Scope of Agreement <br /> <br /> This ~Titing constitutes the entire Agreement between the parties relative <br />to the proposed improvements. However, the City Manager of CITY and the General <br />Manager of ZONE 7 are authorized to interpret this Agreement and to agree in <br />writing that a given act constitutes compliance with a provision of this <br /> <br />Agreement. <br /> <br /> <br />
