Schedule oJ Payments For Section I.A, CONSULTANT s~a!l submit, and CITY shall pay, monthly invoices for the esthnated percentage of work per[ormed during the previous menth, up to 90% of the total amount for said item} the balance to be payable upon completion and acceptance of said work by CITY. For Section I.B, CONSULTANT shall submit, and CITY shall pay~ monthly invoices for the estimated percentage oI work performed during th.e previous month, up to 90% o~ the estimated total for said item. The remaining 10% lot Section I.B shall be paid upon award of a construction contract for the work. In the event PRO3ECT is not bid and awarded within ninety (90) days after receipt by CITY o_.' the completed working drawings, CITY shall pay lot the remaining 10%. For Seclion I.C, CONSULTANT shall submit, and CITY shall pay, monthly invoices for the estimated percentage of work performed during the previous month, up to 90% of the total amount for said item, the balance to be payable upon completion o5 the work and acceptance of the construction by CITY. CONSULTANT shall be paid on a monthly basis at the indicated hourly rates for work completed under Section I.D. In the event PROaECT is terminated, CITY shall pay CONSULTANT lull compensation for work performed to date of written notification to cease work on the PRO3ECT in accordance with Section Vll hereof. If the lowest acceptable construction bid exceeds the budgeted cost of construction by more than 15%, and CITY elects not to approve the excess or to reject all bids and either rebid or negotiate, then CONSULTANT shall, upon request of the CITY, revise the drawings and specifications without additional charge so as to obtain an acceptable bid within 1,s% of the fixed budget limit el constru:tion. CITY will cooperate with CONSULTANT in order to effect such reduclion. CONSULTANT shall have the option of including alternate bid items, additive items or deduct items acceptable to CITY so as to permit flexibility in accepting a bid within the budgeted construction limit.
