To the extent that <br /> District cannot perform the above actions due to <br /> the lack of jurisdictional control, District shall <br /> work with the counties of Alameda and Contra Costa <br /> in an effort to have the above actions made applicable <br /> in District's geographical area. <br /> <br /> 3) Maintenance of a program of public sewer inspection <br /> and repair, and of replacement of defective sewers. <br /> <br /> "c. To budge~ annually and expend funds sufficient for the <br />identification and elimination of system defects permitting inflow <br />and infiltration. <br /> <br /> "d. TO enact and enforce a sewer use ordinance(s) which shall <br />specify procedures and provisions for the District to administer and <br />enforce Pretreatment Program requirements, and which, consistent with <br />Pretreatment Program requirements, shall provide for the issuance of <br />permits by either party at their sole discretion to industrial or <br />commercial users of the District and City sewer systems and for the <br />establishment of user charges including the mandated recovery of <br />federal grant funds from industrial users. Said ordinance(s) shall <br />be mutually acceptable to District and City and to the federal and <br />state agencies having jurisdiction thereof. Nothing in this Agreement <br />or any subsequently adopted sewer use ordinance(s) shall prevent <br />either District or City from continuing in their present form any <br />permits to industrial or commerical users existing at the time of <br />execution of this Agreement or issuing new permits provide~ no <br />discharge from said users would prohibit District from meeting its <br />discharge standards, or would otherwise conflict with requirements of <br />the Pretreatment Program. <br /> <br /> "e.
