will comply with the Federal Water Pollution Control Act Amendments of <br />1972, as amended by the Clean Water Act of 1977, or as otherwise <br />amended, including the establishment of regulations in implementation <br />thereof; and <br /> <br /> WHEREAS, a Pretreatment Program has been prepared for <br /> <br />District; and <br /> <br /> WHEREAS, District must implement the Pretreatment Program <br /> <br />by establishing procedures to prevent the introduction of pollutants <br />into the sewerage collection system and into District's wastewater <br />treatment plant which would interfere with the operation, maintenance, <br />and use thereof, or with reclamation of wastewater, or disposal of <br />sludge residues; and <br /> <br /> WHEREAS, it is necessary for the parties to acknowledge and <br />adhere to the Pretreatment Program with respect to their respective <br />obligations under the 1978 Agreement; <br /> <br /> NOW, THEREFORE; the parties hereto agree as follows: <br /> <br /> 1. Section 9 of the 1978 Agreement is hereby amended to read <br /> <br />as follows: <br /> <br /> "SECTION 9. ADMINISTRATION OF PLANT. <br /> <br /> "District, except as otherwise expressly provided in this <br />Agreement, shall administer, construct, operate, maintain, manage, and <br />control the District Plant in an efficient and economical manner and <br />maintain and preserve it in good repair and working order, all in <br />accordance with sound engineering practices. District agrees to <br />accept, convey, treat, and dispose of all sewage received from City <br />under the terms of this Agreement in such a manner as to comply with <br /> <br /> <br />
