activities, Or proposed actions which might affect the implementation of the NPID-contemplated transportation facilities. d. Smith shall be available, at the request of the City and upon reasonable notice, to attend meetings and give oral and written status reports on the various NPID projects to the City Council, City officials, participants in the NPID, and other individuals, groups, or organizations. 2. Administrative Supervision. Smith shall receive administrative supervision in undertaking the services described herein from the City's Director of Public Works or his designee. 3. Delegation as City's Representative. The City hereby designates Smith to act as its representative with the California State Legislature and various state governmental committees, commissions, and persons involved in governmental affairs affecting the City's interests as described herein. 4. Professional Skill Required. Smith warrants that he has the professional skills necessary, and agrees to use these skills, to perform the services described in this Agreement, and it is understood and agreed that the City is relying on these skills of Smith to do and perform the services in a skillful and professional manner. 5. Applicable Laws. Smith shall perform the services described in this Agreement in full compliance with all applicable laws, rules, and regulations and shall, in cooperation with the City, file all reports required of it or him by applicable law in a timely manner. Compensation. For the services to be rendered pursuant to this Agreement, the City shall pay Smith in accordance with the following: a.
