PROPOSED AMENDMENT TO PLEASANTON MUNICIPAL CODE
The general penalty provisions in the Municipal Code are in Chapter 1.12 (General
Penalty). Section 1.11020 (Infractions) provides that any person who violates
designated chapters of the Municipal Code is guilty of an infraction, punishable by
enumerated penalties. Some of these penalties have been included in the Master Fee
Schedule. For example, the penalty for a violation of Chapter 11.36 (Stopping,
Standing and Parking of Vehicles) is included in the Master Fee Schedule.
Although PMC Chapter 11.36 and other chapters of PMC Title 11 (Vehicles and Traffic)
are listed among the violations designated as infractions in Chapter 1.12, Chapter 11.38
(Residential Parking Permit Zone) is not one of them. The penalty provision for a
violation of Chapter 11.38, instead, has been included in Section 11.38.020 that
currently designates a violation of Chapter 11.38 as an infraction, punishable by a fine
of $25.
Staff recommends amending the Municipal Code to consolidate parking penalties in one
chapter, PMC Chapter 1.12 (General Penalties) and adding to the Master Fee Schedule
a penalty of $52 (which is the proposed penalty) for each violation of Chapter 11.38. A
proposed ordinance amending PMC Chapters 1.12 and 11.38 and a revision to the
Master Fee Schedule to include a penalty of $52 for violating Chapter 11.38 are
attached for your consideration.
Submitted by: Fiscal Review: Approved b,,:
Mich..
