Because the City <br /> does not currently charge a processing fee and approximately $16,400 in administrative <br /> costs are spent each year to process and cancel these citations, staff recommends that <br /> the City Council approve a cancellation fee of $25 to help recover some of the <br /> administrative costs associated with processing these parking citations. <br /> Like all of the other parking penalties in Pleasanton, the penalty for parking in spaces <br /> designated for persons with disabilities has not changed since 1993, and staff <br /> recommends that the penalty be increased. The California Vehicle Code provides that <br /> the maximum penalty for this violation is $500 for the first violation, $750 for the second <br /> violation within 1 year, and $1,000 for the third violation within 1 year. Staff recommends <br /> that the City Council adopt a maximum penalty of $500 per violation (regardless of the <br /> number of violations per year). A penalty of $500 per citation will penalize violators and <br /> deter drivers from parking unlawfully in these spaces. <br /> New Penalties <br /> Staff also recommends that the City Council adopt the penalties proposed for violations <br /> of the California Vehicle Code for parking within 15 feet of a fire station or fire hydrant, <br /> when blocking wheelchair access, sidewalk ramps, bus zones, bike lanes, crosswalks, <br /> and intersections, in front of driveways, on sidewalks, on the roadway side of a parked <br /> vehicle, in tunnels, on bridges, and in posted fire lanes. Penalties are also proposed for <br /> abandoned vehicles. Many of the penalties proposed for these violations are $100 (the <br /> maximum allowable penalty) due to the safety and traffic hazards associated with <br /> parking in these locations. <br /> Staff also recommends increasing the penalties for parking along a curb painted red (in <br /> violation of PMC 11.36.020) and parking for more than 72 hours (in violation of PMC <br /> 11.40.020) to the maximum allowable penalty of $100. The proposed $100 penalty for <br /> parking along red curbs will deter parking in these areas, and it is also consistent with <br /> the proposed penalty ($100) for parking in a posted fire lane. The proposed $100 <br /> penalty for parking longer than 72 hours will align this penalty with the proposed penalty <br /> ($100) for a violation of CVC 22523 (abandon vehicle). <br /> Vehicle License Plate, Registration and Tabs <br /> Staff also recommends adding penalties for expired vehicle registrations, expired or <br /> missing license tabs, and missing license plates to the Master Fee Schedule. The <br /> California Vehicle Code provides that the penalty for these violations may be reduced to <br /> $10 upon proof of correction. The proposed revisions to the Master Fee Schedule <br /> include a $10 penalty for registration and equipment violation citations that are <br /> cancelled when proof of correction is provided to the Police Department. <br /> Page 5 of 6 <br />
