7. Why did this not go to the City Council as a workshop? <br />Response: The City Council has been kept apprised of this proposed conversion from <br />the time the issue first surfaced during the negotiations with the park owner concerning <br />the rents in 2007; at no time did any Council members Express an interest in a <br />workshop. Moreover, by reason of the state statute that appears to put a limitation on <br />city's discretion on these type of applications, it is questionable what useful purpose <br />would have been served by conducting such a wrorkshop. Although no formal <br />workshops before the Commission or Council have been conducted, there have been <br />several "all Park" meetings concerning the conversion; City staff have attended such <br />meetings and kept the residents informed about the process. <br />In order for this conversion to be approved, should not the property be rezoned <br />from its current zoning designation (Comrnercial-Freeway) to a residential zoning <br />district? <br />Response: Although not free from doubt, local governments may be preempted by state <br />law from legislating in the area of converting mobile horne parks to residential <br />ownership, including requiring that the property k~e rezoned to a residential district. <br />9. May the City deny conversion of the Park based on the results of the resident <br />survey? <br />Response: See discussion on pages 4 and 5 of the Memo. <br />10. May the City deny the conversion on grounds that it will result in the loss of 208 <br />rental units? <br />Response: See Response No. 9. In addition, in the absence of a General Plan or other <br />adopted policy that establishes a city wide number (or percentage) of housing units that <br />must be rental, denying an application on grounds that 208 rental units might be lost ten <br />years from now would not be well advised. <br />11. May a city adopt a moratorium on converting molbilehome parks to residential <br />ownership? <br />Response: See pages 6 and 7of the Memo con<erning "Moratorium" <br />12. Does the survey that was conducted indicate that a bona fide majority of the <br />residents wish to convert the park? <br />Response: See page 4 of the Memo concerning "Survey of the Residents". <br />
