BACKGROUND <br />In the late 1980's, the City approved three subdivisions that made up the Golden Eagle <br />development. The development is located on both sides of Foothill Road between <br />Longview Drive to the north and Oak Manor Court to the south. Part of the subdivision <br />improvements included the widening of Foothill Road along the project frontage to <br />accommodate bike lanes and turning lanes. In addition to the street widening, street <br />lights were installed along the east side of the project's Foothill Road frontage. After the <br />street lights were installed, some of the existing neighbors to the south of the Golden <br />Eagle development complained that the street lights were not in character with the rural <br />nature of this portion of Foothill Road. City Council directed staff to work with these <br />residents to see if there were other types of street lights that would be more acceptable <br />to the residents and still provide adequate lighting for the street. It was the conclusion of <br />staff and the residents that there was not a light available that would be acceptable to the <br />neighbors and provide the necessary street lighting. City Council discussed the liability of <br />installing street lights that did not meet the Illuminating Engineering Society (IES) <br />standards for street lighting and concluded that it would be better to have no street lights <br />than having street lights that did not meet the standards. Council directed staff to have <br />the street lights along Foothill Road removed except at the intersection of Golden Eagle <br />Way and Longview Drive. Since the developer had met his obligation to install the street <br />lights, the City had the City's maintenance company remove the poles and lights. The <br />street light pole foundations were left in place such that the street lights could be <br />reinstalled in the future with minimal work. See Attachment C for minutes of Council <br />discussion on this item. <br />The City was recently approached by representatives of the Golden Eagle Luxury <br />Homeowners' Association about installing street lights on the east side of Foothill Road <br />across the frontage of their development. In response to this request, staff scheduled a <br />public meeting to determine the consensus of the residents in the area on this street <br />light issue. Of the 763 residents in the area that were mailed postcards, eleven <br />residents were present at the meeting. Additionally, staff received seven emails and one <br />phone call on the issue. Ten of the residents at the meeting were in favor of having the <br />street lights installed. Of the seven emails that staff received, three were against the <br />installation of street lights and four were in favor of the lights. Most of the comments in <br />favor of the street lights were concerned with animals crossing the street and cars <br />nearly missing the animals as they dash out in front of their vehicles. <br />More recently, staff received a petition from one of the homeowners within the Golden <br />Eagle Development. There were 162 residents that signed the petition in favor of <br />reinstalling the streets lights on Foothill Road along the Golden Eagle frontage. <br />Additionally, the same homeowner circulated another petition for those against the <br />installation of these same street lights. This petition was signed by 5 residents.
