342 <br />Mr. Mercer stated that only one accident is necessary tc have <br />the City sued for inadequate lighting. He expressed concern that <br />if lights are required in front of this project, it should be <br />required for Laguna Oaks as well. <br />Mr. Elliott replied that arrangements could be made to require <br />Laguna Oaks to put in the conduits and allow the spaces necessary <br />for the foundations. <br />Ms. Mohr stated that if the residents do not want the lights <br />at this time, they would not want it at a later time either. She <br />inquired what would determine where Che lights should be installed. <br />Mr. Mercer replied chat the safety factor may require the City <br />to install the lights at a later time. <br />Mr. Tarver commented that he appreciated what is taking place <br />on Foothill Road but that he did not want the exposure to liability <br />if the lighting is not installed according to the standards <br />recommended by staff. <br />It was moved by Mr. Brandes, and seconded by Mr. Mercer, that <br />no lights be installed on Foothill Road except at intersections, <br />where such lights would be according to proper standards. <br />The roll call vote was as follows: <br />AYES: Councilmember Brandes, Mohr, and Mayor Mercer <br />NOES: Councilmembers Butler and Tarver <br />ABSENT: None <br />ABSTAIN: None <br />13. REPORTS OF THE CITY ATTORNEY <br />Mr. Roush inquired if Council could hold a special meeting on <br />Monday, July 23rd, to consider the Council-proposed ballot measure <br />and two agreements with Wells Fargo, in view of the fact that there <br />is a time limitation to submit election information to the <br />Registrar of Voters and that the two agreements may not be ready <br />for the July 17th meeting. <br />Mr. Mercer indicated that Council could meet on Monday, July <br />23rd, at 4:30 p.m. <br />14.
