341
- Mr. Mercer asked Mr. Roush to explain the City's liability
with regard to lighting standards.
Mr. Roush replied that as expressed by Mr. Brandes, it would
be better to have no light than substandard light. He explained
that if a substandard light is installed on the road and an
accident occurs, the plaintiff's attorney could bring in an expert
to say that had it been lit according to the appropriate standards,
the accident would not have occurred. He suggested that any lights
to be installed should meet the standards that the Engineering
Department recommended, and if these standards are not acceptable,
it would be better not to have any lights at all.
Mr. Mercer inquired what the plans were for the Laguna Oaks
Q project.
Z Mr. Elliott replied that no plans have been made for the
Z Laguna Oaks project, pending final decision on the project.
Ms. Acosta stated that the same type of lighting would be
recommended all through Foothill Road.
Mr. Brandes commented that Foothill Road has a semi-rural
atmosphere and that it would be inappropriate to have it brightly
_ lit, except at intersections for safety reasons.
Mr. Mercer stated that what would be most appropriate would be
to put the minimum amount of lighting necessary to meet the law and
to protect the City from liability. He asked Mr. Elliott what the
minimum requirement was.
Mr. Elliott replied that he felt that the staff recommendation
of 150 watts would be the minimum lighting requirement.
Mr. Brandes inquired if having no lights would be an
alternative.
Mr. Elliott answered that it would be an alternative, although
not a viable one. He indicated that there have been some fairly
significant accidents along Foothill Road. ;
Mr. Innes commented that many of the accidents were caused by
the bad design of the "S" turns within Foothiill Road as well as the
narrowness of the road and the ditches on the side. He added that
there are hardly any lights on Foothill Road south of Bernal
Avenue, and no accidents have occurred there since the curve was
redesigned, the ditches filled and the road widened.
7-10-90
- 25 -
