3. Impact on the western pond turtle or their habitat <br />Finding. The City finds that the following mitigation measures are feasible and <br />have been incorporated into the MMRP, thereby mitigating the impact <br />to aless-than-significant level: <br />• Conduct preconstruction surveys for the western pond turtle, <br />per MM BIO-4.1. <br />• Provide exclusion fencing for the western pond turtle, per <br />MM BIO-4.2. <br />DEIR, p. 3.3-20 <br />4. Impacts on nesting birds or their habitat <br />Finding. The City finds that the following mitigation measure is feasible and has <br />been incorporated into the MMRP, thereby mitigating the impact to a <br />less-than-significant level: <br />Preconstruction nesting bird surveys shall be conducted by a qualified <br />biologist. If active nests are found within the construction footprint, <br />delay construction activities within a specified distance from the nest, <br />as determined by the biologist, per MM BIO-5.1. <br />DEIR, p. 3.3-21 <br />5. Impact on riparian vegetation in the Arroyo Mocho <br />Finding. The City finds that the following mitigation measures are feasible and <br />have been incorporated into the MMRP, thereby mitigating the impact <br />to aless-than-significant level: <br />• Obtain a Streambed Alteration Agreement from the CDFG <br />prior to any construction activities that may result in any <br />disturbance to stream corridors, per MM BIO-6.1. <br />• Erect exclusion fencing around the spearscale mitigation <br />area on the north bank of the Arroyo Mocho, per MM <br />BIO-6.2. <br />• Replace the vegetation within the Arroyo Mocho that is <br />removed during construction in accordance with a <br />revegetation plan to be prepared, per MM BIO-6.3. <br />DEIR, p. 3.3-22 <br />In addition, although not required as mitigation to reduce impacts to <br />San Joaquin spearscale to a less than significant level, any <br />development agreement between the Project Sponsor and the City for <br />development of the project site shall require the Project Sponsor, prior <br />to grading the project site, to acquire credits from the Springtown <br />Natural Community preserve in the City of Livermore or purchase land <br />Stoneridge Drive Specific Plan Amendment and Staples Ranch Project <br />Environmental Impact Report Findings and Statement of Overriding Considerations Page 21 of 47 <br />
