S~tion 1. Section 2. 2.1 Recognition Operating Engineers Local Union No. 3, heroinafter referred to as "Union," is the formally recognized employee organization for the Police Employees Unit comprised of the classifications of Police Officer and Police Sergeant certified pursuant to the Employer- Employee Relations Procedures and Resolution No. 71-75, adopted by the City of Pleasanton City Council on April 5, 1971. Union Security Dues Deduction Upon receipt of a written assignment and authorization signed by the employee on the form shown below, the City agrees to deduct from each pay check of such employee in each calendar month an amount which will total the dues uniformly required for membership in the Union. The amount so deducted shall be remitted by the City to the officer designated in writing by the official of the Union as the person authorized to receive such funds. The Union shall notify the City Manager in writing as to the amount of such dues uniformly required of all its members. The emp!oyee's earnings must be regularly suffi~i'ent after other legal and required deductions are made to cover the amount of the dues check-off authorized. When an employee is in a non-pay status for an entire pay period, no with- holding will be made to cover that pay period from future earnings. In the case of an employee who is in a non-pay status during only part of the pay period, and the salary is not sufficient to cover the full wikhholding, no deduc- tion shall be made. In this connection, all other legal and required deductions have priority over Union dues. In addition, in order to meet certain accounting deadlines, all payroll changes connected with the deduction of said Union dues must be made by the fifteenth (151h) of the preceding month. The Union and Operating Engineers AFL-CiO shall indemnify, defend, and hold the City harmless against any and all cl~ims, demands, suits, proceedings or court orders, or any other liability that may arise out of or by reason of action taken or not taken by the City for the purpose of complying ~.~ith any of the provisions of this check- off agreement. In addition, the Union shall refund to the City any amounts paid to it in error upon pre- sentation of supporting evidence.
