S~tion 1. <br /> <br />Section 2. <br /> <br />2.1 <br /> <br />Recognition <br /> <br />Operating Engineers Local Union No. 3, heroinafter <br />referred to as "Union," is the formally recognized <br />employee organization for the Police Employees Unit <br />comprised of the classifications of Police Officer and <br />Police Sergeant certified pursuant to the Employer- <br />Employee Relations Procedures and Resolution No. 71-75, <br />adopted by the City of Pleasanton City Council on <br />April 5, 1971. <br /> <br />Union Security <br /> <br />Dues Deduction <br /> <br />Upon receipt of a written assignment and authorization <br />signed by the employee on the form shown below, the City <br />agrees to deduct from each pay check of such employee in <br />each calendar month an amount which will total the dues <br />uniformly required for membership in the Union. The amount <br />so deducted shall be remitted by the City to the officer <br />designated in writing by the official of the Union as the <br />person authorized to receive such funds. <br /> <br />The Union shall notify the City Manager in writing as to <br />the amount of such dues uniformly required of all its <br />members. <br /> <br />The emp!oyee's earnings must be regularly suffi~i'ent after <br />other legal and required deductions are made to cover the <br />amount of the dues check-off authorized. When an employee <br />is in a non-pay status for an entire pay period, no with- <br />holding will be made to cover that pay period from future <br />earnings. In the case of an employee who is in a non-pay <br />status during only part of the pay period, and the salary <br />is not sufficient to cover the full wikhholding, no deduc- <br />tion shall be made. In this connection, all other legal <br />and required deductions have priority over Union dues. In <br />addition, in order to meet certain accounting deadlines, all <br />payroll changes connected with the deduction of said Union <br />dues must be made by the fifteenth (151h) of the preceding <br />month. <br /> <br />The Union and Operating Engineers AFL-CiO shall indemnify, <br />defend, and hold the City harmless against any and all <br />cl~ims, demands, suits, proceedings or court orders, or <br />any other liability that may arise out of or by reason <br />of action taken or not taken by the City for the purpose <br />of complying ~.~ith any of the provisions of this check- <br />off agreement. In addition, the Union shall refund <br />to the City any amounts paid to it in error upon pre- <br />sentation of supporting evidence. <br /> <br /> <br />
