I, . . <br />V. PUBLIC NOTICE <br />t_ <br />Notices regazding the proposed conditional use permit application and related public hearing <br />were mailed to property owners and tenants within 1,000 feet of the subject property. <br />Craig Schwab, owner of 4431 Stoneridge Drive, contacted staff concerning the proposal. After <br />learning that the proposed after school program would not be using any outdoor area, Mr. <br />Schwab stated that he has no further concerns. <br />VI. FINDINGS <br />The Planning Commission must make the following findings prior to granting of a use permit: <br />A. That the proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which the site is <br />located. <br />Objectives of the zoning ordinance include: fostering a harmonious, convenient, <br />workable relationship among land uses, protecting existing land use from inharmonious <br />influences and harmful intrusions; and insuring that public and private lands ultimately <br />are used for the purposes which aze most appropriate and beneficial to the City as a <br />whole. The existing church operation has been compatible with the surrounding <br />neighborhood, and staff feels that the proposed after school daycare program is an <br />ancillary use which is common to churches and which would be consistent with the <br />above-cited objectives. <br />The subject site is zoned Planned Unit Development -Industrial (PUD-I), where the <br />development plan includes a common landscape area. The proposed after school program <br />would not alter in any way the existing landscaping azea. In addition, the operation of the <br />after school program would not interfere with surrounding businesses' ability to operate <br />as all related activities would be held inside the building. The anticipated number of <br />employees and school children will not generate any unusual demands on the existing <br />pazking for the office complex or the surrounding properties. Furthermore, the applicant <br />will be required to mitigate any nuisances that may occur as a result of the proposed after <br />school program. Therefore, staff feels this finding can be made. <br />B. That the proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, safety, <br />or welfare, or materially injurious to the properties or improvements in the vicinity. <br />Case No. PCUP-84 Planning Commissron <br />Page - 7 - <br />
