V. PUBLIC NOTICE <br />Notices regarding the proposed conditional use permit application and related public hearing <br />were mailed to property owners and tenants within 1,000 feet of the subject property. At the <br />time this staff report is being prepared, no party has contacted staff on the subject matter. <br />VI. FINDINGS <br />The Planning Commission must make the following findings prior to granting of a use permit: <br />A. That the proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which the site is <br />located. <br />Objectives of the zoning ordinance include: fostering a harmonious, convenient, <br />workable relationship among land uses; protecting existing land use from inharmonious <br />influences and harmful intrusions; and insuring that public and private lands ultimately <br />are used for the purposes which are most appropriate and beneficial to the City as a <br />whole. The proposed after-school cultural enrichment program provides structured <br />activities in an enclosed area. In the past, the City has allowed similar uses, such as <br />structured small group tutoring sessions, in various locations in the city, none of these <br />small instructional business has caused any land use conflict with other businesses in the <br />surrounding azea. Staff feels that allowing proposed use if it is operated in a professional <br />manner would be consistent with the above-cited objectives. <br />The subject site is in a multi-tenant office building. Current tenants in the same building <br />are office-oriented businesses. Given the nature of the proposed business, its operation <br />should not interfere with other businesses in the same building or surrounding businesses' <br />ability to operate. The anticipated number of students will not generate any unusual <br />demands on the existing parking for the subject site or the surrounding properties, as <br />sufficient parking spaces are currently available on the subject site. In addition, the <br />condition of the approval requires the applicant to mitigate any nuisances that may occur <br />as a result of the proposed use. Therefore, staff feels this finding can be made. <br />B. That the proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, safety, <br />or welfare, or materially injurious to the properties or improvements in the vicinity. <br />The proposed after-school cultural enrichment program is compatible with other uses in <br />the same business park.
