the neazest residential property on the west side of Santa Rita Road, therefore, the noise <br />and traffic generated from the proposed facility should not impact the residential <br />neighborhood. Additionally, adequate and safe ingress and egress into and out of the site <br />and sufficient on-site parking supports the :proposed use and is suitable for the subject <br />site. In summary, staff feels this finding ca~~ be made. <br />C. That the proposed conditional use will comply with each of the applicable provisions <br />of the zoning ordinances. <br />The site's zoning regulations conditionally permit the establishment of a tutoring facility. <br />In staff's opinion, the proposed use complies with all relevant sections of the zoning <br />ordinance. Therefore, staff believes that the third finding can be made. <br />VII. ENVIRONMENTAL ASSESSMENT <br />Projects of this nature are categorically exempt from the requirements of the California <br />Environment Quality Act (CEQA). Therefore, no c;nvironmental document accompanies this <br />report. <br />VIII. CONCLUSION <br />Staff is of the opinion that the operation of an after-school cultural enrichment program can be <br />accommodated at the subject site without creating adverse impacts on the businesses in the same <br />building or in the surrounding area. Given the diversity of our community, staff believes that <br />the proposed Chinese cultural enrichment program would be a beneficial service to the <br />community, especially to the Chinese community that children would have the opportunity to <br />learn Chinese culture, art, and language. <br />IX. STAFF RECOMMENDATION <br />Staff recommends that the Planning Commission approve Case PCUP-138 by taking the <br />following actions: <br />Make the required conditional use findinp;s as listed in the staff report; and, <br />Approve Case PCUP-138 subject to the conditions listed in Exhibit "B". <br />Staff Planner: Jenny Soo, 925.931.5615 or email:
