The layout of the tenant suite includes four activity areas, an office, a storage area, a foyer, and <br />the program/instruction azeas. <br />IV. ANALYSIS <br />Conditional uses are uses that, by their nature, require individual review to ensure that impacts <br />associated with their use will be minimal. Conditional use permits may be subject to appropriate <br />conditions to ensure that any potential adverse impacts associated with the use will be mitigated. <br />Land Use <br />One of the primary concerns in reviewing a conditional use permit application is the effect of the <br />proposed use on surrounding uses. The subject building is amulti-tenant building, primarily <br />occupied by office uses. The immediate tenant to the north and south are office uses. Other <br />tenants in the same building include a law firm, an insurance office, a chiropractor's office, and <br />other office uses. The proposed after-school program is designated for school-aged children and <br />it provides structured activities in an enclosed space. Staff finds that the proposed use would be <br />a compatible use, as its operation would not likely create significant traffic/noise impacts upon <br />existing tenants. <br />Noise <br />Staff considers the proposed use to be a quiet use as student would be involved in "quiet" <br />activities, such as painting, poetry reading and appreciation, calligraphy, etc. As the floor p]an <br />shows, there aze three individual classrooms within the tenant suite. Thus, activities could be <br />held behind the closed doors to control noise and to help students concentrate and focus on the <br />assignments. <br />As previously mentioned, students would be dropped off after school and be picked up after the <br />program. Thus, it is unlikely that student would socialize in the hallway or that they would <br />congregate in the parking lot before or after the program, causing disturbance to the other <br />businesses. In addition, the subject building is approximately 320 feet from the nearest <br />residential building located on the west side of Santa Rita Road. Staff does not believe that the <br />operation of an indoor after-school program would affect the residential properties. <br />To ensure that noise would not be an issue, staff has included a standard use permit condition of <br />approval that allows the City to review the project again to add mitigating conditions should any <br />complaints occur due to the operation of the proposed business. <br />Case No. PCUP-138 Planning Commission <br />Page - 3 - <br />
