NOW, THEREFORE, City and Owner hereby agree as follows: <br /> <br /> 1. Provision of Water and Sewer Service. City agrees to <br /> <br />allow Owner to connect to City's water and sanitary sewer system <br />upon execution of this agreement prior to annexation of Owner's land. <br />Connection shall be in accordance with the following: <br /> <br /> (a) Owner agrees to pay the then-existing water and <br /> sewer connection fee for connection to the water <br /> and sewer system in accordance with applicable <br /> City ordinances. <br /> <br /> (b) Owner agrees to pay all costs associated with extension <br /> of the water and sewer system to serve Owner's land, <br /> said system to be designed in accordance with City <br /> standards and subject to City approval. <br /> <br /> (c) Owner agrees to pay an amount computed in accordance <br /> with the applicable City formula for connection to <br /> water and sewer facility improvements subject to a <br /> mutual benefit district. reimbursement agreement, or <br /> any other agreement. <br /> <br /> (d) Owner agrees to pay a monthly water and sewer service <br /> charge as is now or may hereafter be specified by <br /> ordinance. <br /> <br /> (e) Owner agrees to dedicate the necessary right-of-way for <br /> Amber Lane from Sycamore to Rosepoint Subdivision. <br /> <br /> (f) Owner agrees to fill or remove the existing septic <br /> tank to the satisfaction of the City Engineer. <br /> <br /> (g) Owner agrees to abandon and seal the existing water <br /> well on the property to the satisfaction of the City <br /> Enoineer. <br /> -2- <br /> <br /> <br />
