PREANNEXATION AND PROVISION OF WATER AND <br />SEWERAGE FACILITIES AND SERVICES AGREEMENT <br /> <br /> THIS AGREEMENT is made and entered into this day <br /> <br />of , 1984 by and between the City of Pleasanton, <br /> <br />a municipal corporation (hereinafter referred to as "City") and <br />Robert W. Byrd (hereinafter referred to as "Owner"), based on the <br />following understandings: <br /> <br /> W I T N E S S E T H: <br /> <br /> WHEREAS, Owner wishes to connect to the City water and sewerage <br />system in order to eliminate reliance on well water and septic tank/ <br />leachfield systems of effluent disposal prone to failure and con- <br />tributory to creation of public health hazards; <br /> <br /> WHEREAS, City policy requires annexation prior to extension <br /> <br />of such City services as water and sewerage facilities; <br /> <br /> WHEREAS, City, in accordance with State and LAFCO policies <br /> <br />and regulations regarding annexation, either cannot or is unwilling <br />to annex small portions of neighboring areas in piecemeal fashion, <br />but may wish to annex such properties either alone or in conjunction <br />with a larger area at some future time; <br /> <br /> WHEREAS, the public health, safety, and welfare of the City's <br />residents as well as those in the neighborinq community are best <br />served by elimination of inadequate well water and sewerage treatment <br />systems and connection to City water and sewerage facilities; and <br /> <br /> WHEREAS, City policy is adequately preserved through the <br />provisions of an agreement wherein Owner consents to annexation <br />to City at such time as City may require; <br /> <br /> <br />
