2. Agreement to Annex. Owner agrees to consent to annex to <br /> <br />the City of Pleasanton all those lands described herein at such time <br />as City may require. Owner and City agree that the provisions of this <br />agreement, State and County laws, and City ordinances and resolutions <br />shall control the responsibilities of both parties at the time of <br />annexation. Owner further agrees to cooperate with City in the <br />annexation of the lands described herein, whether alone or as part <br />of a larger area, and expressly waives the right to protest said <br />annexation and agrees to do no act calculated or tending to prevent, <br />impede, or defeat the successful annexation of said property. <br /> <br /> 3. Land Subject to This Agreement. The land subject to this <br />agreement shall be those lands of Owner more particularly described <br />in the legal description and map attached hereto as Exhibit A and <br />made a part hereof. <br /> <br /> 4. Bonded Debt. Owner does hereby consent that, upon annexation <br />of his property to City, said property shall be taxed to pay its <br />share of existing bonded indebtedness of City. This agreement shall <br />serve as such consent, and a copy shall be filed with the Treasurer- <br /> <br />Tax Collector of Alameda County, if evidence of such consent is required; <br />provided, however, that Owner's property will be excluded from the <br />City bonded debt existing on the effective date of this agreement <br />and from and after the annexation of his property to City for all <br />utility facilities to which Owner's property is not connected. <br /> <br /> 5. Taxes. Owner understands that after annexation has been <br /> <br />completed said property shall be subject to all real property taxes. <br /> 6. Assessment Districts. Owner agrees to cooperate with City <br /> <br />in the formation of any mutual benefit districts or assessment districts <br />which City deems necessary for the installation of public improvements <br /> <br />-3- <br /> <br /> <br />
