7. Modify the first paragraph on page 59. <br />Existing Language <br />As specified in the September 2007 Pre-Development .and <br />Cooperation Agreement between Vulcan Materials, Livermore, <br />Pleasanton, Alameda County, and the ACSPA, improvements to EI <br />Charro Road, if not already completed by the City of Livermore for the <br />EI Charro Specific Plan development, would also need to be <br />constructed by the ASCPA (under the Development Agreement with <br />the City of Pleasanton) as part of any first phase of Staples Ranch <br />development. Similarly, as permitted under the September 2007 Cost- <br />Sharing Agreement between Livermore, Pleasanton, and the ACSPA, <br />the Livermore flood control improvements planned for the EI Charro <br />Specific Plan, if not already completed by the City of Livermore, would <br />also need to be constructed by the ASCPA as part of any first phase of <br />Staples Ranch development. <br />Proaosed Modification <br />As specified-in required by and subject to the September 2007 Pre- <br />Development and Cooperation Agreement between Vulcan Materials, <br />Livermore, Pleasanton, Alameda County, and the ACSPA, if the <br />improvements to EI Charro Road; i# are not already completed by the <br />City of Livermore for the EI Charro Specific Plan development, <br />Pleasanton would also need to cause them to be constructed by the <br />AAA ACSPA (under the Development Agreement with the City of <br />Pleasanton) as part of any first phase of Staples Ranch development. <br />Similarly, as perritted required under the September 2007 Cost- <br />Sharing Agreement between Livermore, Pleasanton, and the ACSPA, <br />if the Livermore flood control improvements planned for the EI Charro <br />Specific Plan; i# are not already completed by the City of Livermore, <br />Pleasanton would also need to cause them to be constructed by the <br />AAA ACSPA as part of any first phase of Staples Ranch <br />development. Any such roadway and flood control improvements shall <br />be constructed so as to comply with all applicable provisions of the <br />Cooperation Agreement, including but not limited to Section 3.2 <br />thereof. <br />{This modification was recommended by Vulcan Materials.} <br />Recommended Revisions <br />Page 4 <br />
