the growth management approval so expiring may be reallocated by the <br />City in accordance with its Growth Management Program. <br /> <br /> 2. Ponderosa will acquire and become the fee owner of that <br />certain property known as Parcels A, B and C of Parcel Map No. 4122 <br />as shown on Exhibit "A" attached hereto and made a part hereof (the <br />"Property"). In connection with such acquisition, Ponderosa will <br />allocate 145 sewer permits issued to Ponderosa by the Dublin-San <br />Ramon Sewer District pursuant to the 1972 Settlement Agreement for <br />utilization in the development of the Property in accordance with the <br />schedule described hereinbelow. <br /> <br /> 3. In addition to allocating sewer permits to the Property, <br />Ponderosa wishes to amend the allocation of sewer permits as pre- <br />viously designated under the Third Addendum to Long-Term Agreement <br />from 20 units in 1984 to 36 units in 1984; and from 17 units in 1985 <br />to 0 units in 1985. <br /> <br /> 4. All the terms and conditions of the Long-Term Agreement <br />shall remain in full force and effect as to the Project except as <br />explicitly provided herein. <br /> <br /> 5. The parties hereto covenant and agree that the growth <br />management approval granted to Ponderosa pursuant to the Long-Term <br />Agreement shall apply to the Third Addendum in accordance with the <br />following schedule: for the calendar year 1984 the growth management <br />approval utilized is 36 units. The parties also hereto covenant and <br />agree that the growth management approval granted to Ponderosa <br />pursuant to the Long-Term Agreement shall apply to the Property under <br />this Fourth Addendum in accordance with the following schedule:for <br /> <br />-2- <br /> <br /> <br />
