Box 520 <br />Pleasanton, CA 94566 <br /> <br /> FOURTH ADDENDUM TO LONG-TERM AGREEMENT <br /> <br />AND MODIFICATION TO THIRD ADDENDUM TO LONG-TERM AGREEMENT <br />BETWEEN CITY OF PLEASANTON AND PONDEROSA HOMES <br /> <br /> This Fourth Addendum to Long-Term Agreement ("Fourth Addend- <br /> <br />um") is made this day of , 1984 by and between <br /> <br />PONDEROSA HOMES, a general partnership ("Ponderosa"), and THE CITY <br />OF PLEASANTON, a municipal corporation ("City"). <br /> <br /> 1. City and Ponderosa have heretofore made and entered into an <br />agreement entitled Long-Term Agreement dated August 24, 1982 and <br />recorded in Alameda County Records on November 23, 1982 as Series No. <br />82-178300 as amended by First Addendum and Second Addendum recorded <br />on May 3, 1983 as Series No. 83-073964 and 83-073965 respectively and <br />Third Addendum recorded September 28, 1983 as Series No. 83-180909 <br />(collectively the "Long-Term Agreement"). Pursuant to Article I.A. <br />of the Long-Term Agreement, City granted Ponderosa growth management <br />approval for the Project (as defined in the Long-Term Agreement) <br />including, inter alia, 75 units in 1983, 150 units in 1984, and 150 <br />units in 1985. Pursuant to Article II.B of the Long-Term Agreement, <br />building permits may be granted pursuant to the Long-Term Agreement, <br />and for utilization within the time limit set forth in the Long-Term <br />Agreement.
