Agreement shall be in final form to be mutually <br />agreed upon and shall be generally consistent <br />with Government Code sections 65864, et seq. <br />Based on the City findings referred to in Recital <br />E of this Agreement, it is contemplated that <br />the Development Agreement will reflect appropriate <br />terms of this Agreement, and other appropriate <br />and consistent terms, including the following: <br /> <br /> (1) Owners shall have the right to <br /> subdivide and use the P.U.D. Area for all <br /> uses allowed in the Central Commercial ("CC") <br /> Zoning District; <br /> <br /> (2) no subdivision or use of the P.U.D. <br /> Area shall occur until City has approved <br /> a development plan for the P.U.D. Area or <br /> appropriate portions thereof; <br /> <br /> (3) a total of approximately three <br /> thousand (3,000) square feet of building shall <br /> be permitted in the P.U.D. Area and such space <br /> may be allocated by Owners in two different <br /> buildings within the P.U.D. Area, provided, <br /> however, that no building shall be greater than <br /> one (1) story in height; <br /> <br /> (4) City reserves the right to reasonably <br /> restrict parking-intensive uses because of lack <br /> of any parking on the adjacent street; <br /> <br />-8- <br /> <br /> <br />
