(5) if subdivision and use of the P.U.D. <br /> <br /> Area so requires, appropriate sound protection <br /> shall be provided for the motel units in the <br /> existing building immediately northerly of the <br /> P.U.D. Area; <br /> <br /> (6) the DevelopmentAgreement shall be <br /> <br />for a term of eight (8) years and may be <br />extended by mutual consent, provided however, <br />such eight-year term shall exclude any period <br />of time related to a governmentally imposed <br />moratorium; <br /> <br /> (7) Owners shall have the right to remove <br /> <br />or modify portions or all of the wall in connection <br />with development under the Development Agreement; <br /> <br /> (8) the Development Agreement, if adopted, <br />shall be recorded and shall be transferable by <br />Owners subject to all of its provisions and the <br />provisions of Government Code section 65868.5; <br /> <br /> (9) the rules, regulations and official <br />policies governing permitted uses of the P.U.D. <br />Area, density, design, improvement and <br />construction standards and specifications shall <br />be those in force at time of execution of the <br />Development Agreement; but the Development <br />Agreement shall not prevent the City in <br />subsequent actions applicable to the Owners' <br /> <br /> <br />
