The City shall, at City expense, also <br />construct, complete and maintain as part of the street <br />and within the forty feet (40') right-of-way a <br />masonry, sound-proof wall, eight feet (8') in height <br />from the surface of the adjacent sidewalk (the "wall"). <br />The wall shall be shown on Exhibit "C" as part of the <br />street, shall contain three driveways and curbcuts <br />either as shown on Exhibit "C" or in the Development <br />Agreement, and shall include appropriate, lockable <br />gates at said driveways and curbcuts. <br /> <br /> The City shall, at City expense, also <br />install and maintain appropriate landscaping on the <br />street side of the wall as shown on Exhibit "C". <br /> <br /> Construction of the wall shall be completed <br />and accepted by City in no event later than the <br />completion of and acceptance by City of the street <br />and before the street is open for public use. All <br />equipment and vehicles of any kind used to construct <br />Valley's Tract 5164 and the street shall use the <br />Valley Avenue frontage of Tract 5164. <br /> <br />If the street, without the wall, has been completed <br />and accepted by City prior to completion and acceptance <br />by Valley of Tract 5164, Valley shall continue to use <br />the Valley Avenue frontage of Tract 5164, and not the <br />street, during the remaining time necessary to complete <br /> <br />-6- <br /> <br /> <br />
