in court by City of the said Judgment in Condemnation <br />in the Condemnation action; (2) the simultaneous filing <br />in court by Owners of a dismissal with prejudice of <br />all parties to the mandate action; and (3) the simultaneous <br />or prior execution by City, Valley and Owners of a Mutual <br />General Release. This sum of Two Hundred Thousand <br />Dollars ($200,000.00) and the provisions of Subparagraphs <br />2.C and 2.D of this Agreement shall be just compensation <br />for the interests in the subject property so taken <br />together with improvements on the subject property, if <br />any, and for all damage of every kind and nature, if <br />any, suffered because of the taking of the subject <br />property. In the event City takes possession of the <br />subject property prior to payment to Owners of the <br /> <br />Two Hundred Thousand Dollars ($200,000.00) referred to <br />herein, and any portion or all of the Two Hundred <br />Thousand Dollars is deposited with the court in the <br />Condemnation action or in escrow, Owners shall be <br />exclusively entitled to all interest accursed on said <br />deposit. <br /> <br /> C. City shall, at City expense, construct, complete <br />and maintain on the subject property a fully improved public <br />street forty feet (40') in width according to the diagram <br />entitled "Tanager Exten.tion Reconstruction/Santa Rita <br />Road Connector Street", attached hereto as Exhibit "C" <br />and incorporated by reference (the "street"), with a sidewalk <br />on the northerly side of the street as shown on Exhibit "C". <br /> <br />5 <br /> <br /> <br />
