As reflected in the PC <br />meeting minutes, the PC noted that the applicants <br />operations appeared to be similar to that of a "day care" <br />facility and suggested that the applicant should consider <br />securing a license from the State to operate as such. <br />The PC denied the CUP without prejudice, due to its <br />inability to make the second finding regarding public <br />health, safety, and welfare. <br />February 15, 2008 The applicant appealed the PC's decision to the City <br />Council (CC) for their review and consideration. <br />May 6, 2008 The City Council (CC) held a public meeting regarding <br />the applicant's appeal of the PC's action. The CC also <br />felt that TVMAA operations were similar to a day care <br />facility. The applicant did acknowledge during the <br />hearing that he does provide "care for children" but he <br />was not a day care. The CC denied the applicant's <br />appeal thereby upholding the PC's denial of the CUP <br />application and suggested that he look into State <br />licensing for a day care facility. <br />May -July 2008 The applicant revised the scope of operations to <br />address the City's concerns while working with DSS to <br />secure licensure for a child care center. <br />July 17, 2008 TVMAA submitted a CUP to operate a martial arts/child <br />care center. <br />August 13, 2008 TVMAA was scheduled for the PC public hearing, <br />however, was continued to the next available PC <br />hearing at the request of Commissioner Anne Fox. <br />August -October 2008 TVMAA CUP application was noticed and continued by <br />staff in order to respond to an increasing number of <br />questions submitted by Planning Commission members <br />after publication of the August 13, 2008 PC staff report; <br />which entailed receiving clarifying information from DSS. <br />November 12, 2008 TVMAA CUP was presented before the Planning <br />Commission for review and action. The Planning <br />Commission approved the CUP on a temporary basis <br />until the applicant secures the necessary State license <br />for a Childcare Center. <br />3 of 3 <br />
