PCUP-229 / 1262 QUARRY LANE, SUITE A <br />TIMELINE <br />submit a revised narrative that more accurately <br />portrayed the scope of TVMAA operations. <br />December 26, 2007 Staff sent a letter to NMAA stating that although <br />Planning typically allows businesses to operate while <br />applications are being processed, after meeting with the <br />applicant, staff determined that TVMAA must cease <br />operations until a CUP was secured. <br />December 31, 2007 Staff received a letter from the Department of Social <br />Services stating that their re-evaluation of the <br />applications scope of operations is sufficient to exempt <br />TVMAA from State licensure. <br />January 4, 2008 Staff met with the applicant to discuss his concerns <br />regarding staffs decision to have NMAA ceasing <br />operations pending receipt of a CUP. During this <br />meeting the applicant provided staff with a revised <br />narrative outlining the modifications of the previous <br />submitted narrative; however, staff declined to allow <br />TVMAA to operate until the CUP was heard by the PC. <br />January 9, 2008 Staff provided TVMAA with a letter summarizing the <br />January 4, 2007 meeting stating that the business <br />cannot operate and that the CUP has scheduled for the <br />February 13, 2008 PC meeting. <br />January 14, 2008 TVMAA sent staff a letter regarding the decision to <br />cease operations in hopes of further clarifying the scope <br />of his operations so that TVMAA could continue <br />operating while the CUP is being processed. <br />January 18, 2008 The applicant met with Jerry Iserson, former Planning <br />and Community Development Director, regarding the <br />second narrative that was submitted. The outcome of <br />this meeting resulted in the applicant revising his <br />narrative for a third time. The applicant modified the use <br />to meet the parking and circulation requirements and in <br />an effort to accurately portray the proposed use. <br />January 2008 The City's Code Enforcement Officer conducted five site <br />visits to the subject location to ensure that TVMAA was <br />in compliance with the City's letters directing TVMAA to <br />cease operations. Based on their observations, it <br />appeared that on January 18, 2008 the applicant was <br />operating at the facility. The applicant stated that he <br />2 of 3 <br />
