(2) Care, supervision, and instruction from 8:30 a.m. to 6:15 p.m. on school holidays, <br />two weeks during the school winter break, one week during the spring break, and <br />ten weeks during the school summer break; <br />(3) Transportation of children would be provided from elementary and middle schools <br />to the facility except during the seasonal camps; and <br />(4) Martial arts classes for up to 20 students ages 13 and above, Monday through <br />Friday from 6:45 p.m. to 9:00 p.m. <br />(5) Staffing at the facility will consist of one site director (Mr. Pfund), one teacher, and <br />one teacher's aide. Mr. Pfund will be the only instructor on-site during the evening <br />class. <br />For additional project information please refer to the Planning Commission staff report <br />(Attachment 6) and the applicant's written narrative (Exhibit A, Attachment 2). <br />DISCUSSION <br />Staff presented the proposed conditional use to the Planning Commission with <br />conditions of approval that intended to meet the previous direction of the City Council <br />and to ensure and maximize the success of the facility. The Planning Commission <br />expressed various concerns related to the timing of the project, the classification of the <br />project and how the project, as conditioned, mitigated those concerns. They discussed <br />the following issues: <br />• Outdoor Plav Area: <br />The Commission discussed the appropriateness of approving a childcare facility within <br />an industrial zoned district that could not provide an outdoor play area meeting the 75 <br />square feet per child requirement. One member of the Planning Commission was <br />particularly concerned about the practice of opening the rear overhead roll up door <br />periodically throughout the day to provide sunlight and fresh air. The opening would be <br />secured with a sturdy fencing material to prevent children from exiting through the roll <br />up door when open. <br />The Planning Commission agreed with the State's and staff's conclusion about the adequacy of <br />the indoor recreation space for this particular facility. No additional condition was required by <br />the Planning Commission. <br />• Building Occupancv: <br />The Commission considered the information provided by the City Building Official that <br />the classification of daycare/childcare use constitutes a change in occupancy from B to <br />an E occupancy based on the adopted 2007 California Building Code (2007 CBC). The <br />change in occupancy would be required to satisfy the code requirements. There are <br />various ways in which to meet these requirements which would be determined when <br />plans are submitted to the City for a building permit. <br />Page 4 of 10 <br />
