The Planning Commission stated that the Building Division is the appropriate authority on what <br />the requirement for an E occupancy may be along with the review by the Fire Marshall. The <br />project was conditioned as follows.• <br />20. Prior to issuance of a business license, the applicant shall contact the Building and <br />Safety Division and the Fire Marshall to ensure that the proposed use of the tenant space <br />meets Building and Fire Code requirements. If required, the applicant shall obtain all <br />appropriate City permits. <br />21. Any tenant improvement plans shall be submitted to the Building and Safety Division <br />for review and approval. The applicant shall obtain a building permit prior to <br />commencement of any work. Tenant improvements may require up-dating the ADA parking <br />requirements for the subject site. The applicant shall pay any and all fees to which the <br />proposed application may be subject to prior to issuance of building permits. The type and <br />amount of the fees shall be those in effect at the time the building permit is issued. <br />• Training Proos: <br />The Planning Commission requested confirmation if operable weapons/handguns were <br />used when Mr. Pfund operated Tri-Valley Martial Arts in Dublin. The Commission <br />expressed concern regarding such weapons on site for a childcare facility and also <br />questioned whether mock guns that looked very close to being an operable weapon <br />were appropriate at the proposed childcare facility. <br />Staff confirmed that Mr. Pfund did use operable, unloaded weapons for his adult <br />instruction in Dublin to familiarize the students with how weapons may be used in <br />various scenarios. This training technique helps to remove fear when a student may be <br />confronted with an assailant brandishing a weapon. Ammunition was also present at <br />the Dublin site in a location inaccessible to students. The weapons were not used when <br />the children were present. <br />Staff discussed the issue with CCLD. The State did not support operable weapons for <br />use at the facility during the day, however, CCLD acknowledged the value in using <br />mock weapons for training during the adult classes. The State further determined that <br />because the childcare center is separate from the adult classes. Mr. Pfund could use <br />mock guns during the adult classes. <br />The Planning Commission determined that it was reasonable to allow mock guns if they were a <br />bright color, not real, and used in the adult classes only, and were not in view when children are <br />present.
