53. All trees used in landscaping shall be a minimum of 15 gallons in size and all <br />shrubs a minimum of five gallons, unless otherwise shown on the approved <br />landscape plan. <br />54. Landscaping installation time requirements: <br />a. Prior to building permit final, all front yard landscaping shall be installed <br />and inspected. <br />b. Within 90 days of occupancy, all rear yard landscaping shall be installed. <br />55. The applicant and future homeowners are encouraged to use recycled gray <br />water, rain water, etc., for landscape irrigation. If used, the details shall be shown <br />on the building permit plan set to the satisfaction of the Director of Community <br />Development before issuance of a building permit. <br />56. The applicant and future homeowners are encouraged to use best management <br />practices for the use of pesticides and herbicides. <br />Disclosure/Clause/Easement Conditions <br />57. Prior to recordation of the tentative map, a deed disclosure shall be recorded on <br />all lots covered by this approval stating that: <br />a. Any new additions on Lots 2, 3, 4, and 6 and accessory structures of any type <br />on Lot 6 are prohibited. <br />b. Parking is prohibited at all times within the joint-access driveway. Moving, <br />delivery, and any other type of service vehicle must either park within the <br />home's garage or designated parking spot, or park on the public street. <br />c. The property is in an area subject to noise, activity, and traffic impacts <br />associated with a Downtown location. <br />d. The residents, tenants, and guests, etc. are prohibited from parking in the <br />private drive area. <br />58. The project developer/subdivider shall disclose to any prospective owners of the <br />maintenance of the private access drive. The City Attorney and City Engineer <br />shall approve the exact language of the notice. <br />59. The project developer/subdivider shall disclose to any prospective owner(s) of <br />these lots of the maintenance responsibility of any vegetated swales and private <br />storm drain systems on this site. The City Attorney shall approve the exact <br />language of the notice before the final map is recorded. <br />60. The project developer/subdivider shall disclose to any prospective owner(s) of <br />the City's requirement that future improvements, modifications, and/or new <br />construction shall be compatible with the materials and design of the <br />neighborhood and the approved homes in the development. The City Attorney <br />shall approve the exact language of the notice before the final map is recorded. <br />11 <br />
