f <br />At the second public heazing on April 30, 2008, the Zoning Administrator discussed the <br />outcome of the site visits. Ms. Decker requested that the applicant have his landscape designer <br />prepare a list of plants and trees that the neighbors could review. The applicant was given two <br />weeks to meet with his landscape designer to produce a list and continued the heazing until the <br />neighbors had an opportunity to review and consider the list. <br />After the April 30 hearing, the applicant continued to move forward with his yard improvements <br />(i.e. the pool and retaining wall). The detailed landscape plan that was requested to be provided <br />from the applicant was not provided to the neighbors or staff. Therefore, the Zoning <br />Administrator held a third hearing on July 10, 2008. The neighbors stated their concern with the <br />work that continued to be occurring at the applicant's home without detailed landscape plans. <br />The Johnston's felt that they could possibly agree to the grade change if the applicant planted <br />the majority of the yard with mature dense landscaping and that a condition be added that <br />restricts play structures, tables, or general outdoor use in that azea. <br />The Zoning Administrator felt that the goal was to return the privacy to both parties and that a <br />solution could be reached with the some changes to the type, location, and number of trees and <br />shrubs that were proposed. Therefore, the Zoning Administrator approved Mr. Jeffrey's request <br />to re-grade and provide landscape in the rear yazd area of his yard subject to the conditions <br />found in Exhibit B of this report. <br />Please see the Zoning Administrator meeting minutes (Exhibit F) for detailed information <br />regarding the three Zoning Administrator hearings. <br />PROJECT DESCRIPTION <br />The applicant has constructed an approximately four foot tall concrete stack block retaining wall <br />along the inside edge of the drainage easement, approximately 15 feet from his rear property <br />line, and used the majority of the excess soil from the pool excavation to fill in an approximately <br />four foot wide strip on the interior of the retaining wall. The new retaining wall replaced an <br />existing four-foot tall redwood fence that was located adjacent to the reaz yazd drainage ditch <br />located within the drainage easement approximately seven feet from the existing reaz yard <br />property line. The applicant provided staff with a conceptual landscape plan that illustrated his <br />intent to replace the removed landscaping along the reaz and side of his property also intending <br />to provide additional landscaping to create a wider planter area than existed before. <br />At the time of the Zoning Administrator's action, the applicant had off-hauled most of the <br />excess soil. <br />PAP-123, Appeal of PDR-715 Planning Commission <br />4 of 7 <br />
