The Lams, 3105 Catawba Court, also have concerns regarding the removal of the landscaping.
They feel that the removal of the landscaping has changed the appearance and feel of their
backyard area. The Lams are also concerned with the amount of noise that will be generated
from the applicant using the backyard area because the noise "buffer" (landscaping) has been
removed. Without the mature landscaping, the houses surrounding and above the Johnston and
Lam properties are visible. The Lams would like to see landscaping along the rear and side of
the property similar to what was there prior to the grading of the site.
Please see Exhibit fl for correspondence from the applicant and rear neighbors and Exhibit I for
additional photographs.
Zoning Administrator Hearings
At a public hearing on April 16, 2008, the Zoning Administrator, Donna Decker, decided that
the applicant and neighbors should use this meeting to provide comments and that another
hearing would be scheduled to accommodate the discussion and resolution of the neighbors
concerns. After receiving public testimony from the neighbors and applicant, the Zoning
Administrator determined that site visits to the neighbors and applicants' properties would be
appropriate to better assess the comments received.
Mrs. Decker and staff met with the involved parties, on an individual basis at their properties, to
listen and discuss their concerns. During these visits, Ms. Decker assessed potential impacts
from the removal of the landscaping and proposed grade change and discussed with the
neighbors and the applicant possible solutions.
PAP-123, Appeal of PDR-715
Planning Commission
3 of 7
