~.., ~_ <br />Mr. Jeffrey stated the pool and retaining wall have been constructed and completed with <br />the proper pemuts. <br />Mr. Jef&ey explained that the landscape plan he submitted shows more than enough to fill <br />the void along the whole back portion of his property. He stated he does not want to see <br />pool equipment or other two-story homes. <br />Mr. Jeffrey stated that he had the same privacy concerns as the reaz neighbors and he does <br />not intend on leaving the reaz yazd area "open" and he will be providing dense screening. <br />Ms. Decker asked how high and how fast the trees would grow and if they aze evergreen <br />trees. <br />Mr. Jeffrey answered that the trees would be evergreen and that he would look up the <br />height and growth rate. <br />Ms. Decker asked why the vegetation was removed in the first place as the trees were at <br />the very edge. <br />Mr. Jeffrey explained that he was redoing his backyard and wanted to get the maximum <br />use of his property. He also stated that the trees were a maintenance issue for him and that <br />there was a I S-foot easement along the rear of his property which limited the amount of <br />work he could do. <br />Ms. Decker asked how long he had lived at his residence and if he was aware of the <br />landscape restrictions. <br />Mr. Jeffrey answered that he has lived there since 2005 and was not aware of the <br />restrictions until code enforcement knocked on his door. <br />Ms. Decker asked if he had thought about talking to his neighbors about taking out all the <br />vegetation. <br />Mr. Jeffrey replied that he was replacing what he was taking out, so he did not think it was <br />an issue. He stated his goal was the same as his neighbors. <br />Ms. Decker stated that the pool was permitted, but the complication with the pool is that it <br />created grading on the site. The Tract Map Conditions of Approval required any grading <br />and off-haul of material needed to be reviewed and approved by the City Council. <br />Ms. Decker apologized for the confusion regazding these kinds of conditions. <br />Mr. Johnston asked if because of the unique situation regarding the conditions, that the <br />permit was issued in error. <br />ZA Hearing, PDR-715 July 10, 2008 <br />
