~ n <br />Commlttee, the purpose of said enclosure being the same ae above <br />stated. <br />ARTICLE IV <br />ARCHITECTURAL CONTROL <br />Section 1. Architectural Committee. The Committee for the <br />contro o • rue ura an an seep ng arc itecture and design <br />within the subdivision shall be known as the Architectural <br />Committee and shall consist of five (5) members. <br />(a) Declarant has appointed the Architectural <br />Committee comprised of , , <br />an w o are <br />oca s a n ree , easanton, a orn a. The <br />Committee may designate a representative to act for it. In case <br />of death or resignation of any member of the Committee, the <br />remaining members shall have full authority to designate a <br />successor. Neither the members of the Committee nor its <br />designated representative shall be entitled to any compensation <br />for services performed under this covenant. <br />(b) Declarant reserves the right to appoint-all <br />replacements until the first anniversary of the sale of the first <br />lot within the Subdivision, and reserves to itself the power to <br />appoint a majority of the meabars of the Committee until ninety <br />percent (90!) of all the subdivision interests in the overall <br />development have been sold or until the fifth (5th) anniversary <br />of sale of the first lot within the subdivision, whichever first <br />occurs. <br />(c) After one (1) year from the date of the sale of <br />the first (1st) lot within the •ubdivision, the majority of-lot <br />owners shall have the power to appoint one (1) member to the <br />Architectural Committee until ninety percent (90$) of all of the <br />subdivision interests in the overall development-have been sold <br />or until the fifth (5th) anniversary date. of the sale of the <br />first (1st) lots within the subdivision, whichever first occurs. <br />Thereafter the majority of lot owners shall hove the power to <br />appoint all of the members of the Architectural Committee. <br />(d) Members appointed to the Architectural Committee <br />by the lot owners within the subdivision shall be from the lot <br />owners within the subdivision. Members appointed to the <br />Committee by the subdivider need not be owners of lots within the <br />subdivision. <br />(e) The Committee's approval or disapproval as <br />required in these covenants shall be in writing. In the event <br />the Committee, or its designated. representatives, fail to approve <br />or disapprove oz otherwise fail to act within thirty (30) days <br />9 <br />
