B. For the period of December 1 through December <br /> 31, 1985, and December 1 through December 31, <br /> 1986, the monthly rental fee shall be NINE <br /> HUNDRED AND NO/100THS DOLLARS ($900.00). <br /> <br /> 4. Lessee shall pay Lessor monthly for the cost of all <br />utilities including water, gas, heat, electricity and power which <br />may be furnished to or used on or about the premises during the term <br />of this Lease. It is understood that said sums may vary from month <br />to month depending upon usage. Lessee further agrees to pay the <br />costs of replacing nets, center straps, back-drops, broken, lost or <br />stolen light fixtures; any windows broken; as well as the costs of <br />the necessary supplies to the restroom facilities. <br /> <br /> 5. Lessor agrees that Lessee shall have exclusive use of <br />the Young California Building and parking areas delineated on <br />Attachment A for the term of this Lease. <br /> <br /> 6. Should Lessee holdover said premises after the Lease <br />has terminated in any manner, such holding over shall be deemed <br />merely a tenancy from month to month on the same terms and <br />conditions as herein provided. However, Lessee expressly agrees <br />that Lessee shall have no right to use the premises during the <br />months of June and July. <br /> <br /> 7. Lessee shall, at Lessee's own expense, have and <br />maintain for the purpose of and during the full term of this Lease, <br />in full force and effect, insurance policies, with insurance <br />carriers duly and regularly licensed to transact business in the <br />State of California in the following forms, manner and amounts: <br /> <br /> A. Workers' compensation insurance to cover the <br /> liability of Lessee in accordance with the <br /> provisions of Division 4 of the Labor Code of <br /> the State of California and any and all acts <br /> mandatory thereof. <br /> <br /> B. Lessee acknowledges that it will maintain at its <br /> own expense, liability insurance not less than <br /> five (5) million dollars but that lessee is <br /> self-insured for all injuries in an amount up to <br /> $200,000. <br /> <br /> 8. The premises are hereby leased to Lessee upon the <br />express condition that Lessee shall use said premises as a tennis <br />and recreational facility. Lessee shall put the building to no <br />other uses except upon giving one week notice to the Lessor with <br />such other uses to be subject to the approval of Lessor. Lessee <br />agrees that no goods, merchandise or materials of a hazardous nature <br />shall be kept, stored, or sold in said premises. <br /> <br /> 9. Lessee shall have the exclusive rights for tennis <br />courts on the Fairgrounds during the term of this Lease period. <br /> <br /> 10. Lessor shall prepare the interior of the Young <br />California Building for use as a tennis facility prior to Lessee <br /> <br /> - 2 - <br /> <br /> <br />
