taking possession of said premises with such preparation made by the <br />Lessor to include standardized tennis nets and necessary materials <br />for back nets for each court of which there shall be four (4) indoor <br />tennis courts, and suitable off-court floor area. Lessor shall make <br />"good faith" effort to protect the floor during that period when the <br />facility is not being used for tennis. Lessee accepts "good faith" <br />effort to be the use of the carpet presently in use to cover the <br />floor between April 1986 and November 1986 and understands the <br />existing carpet will not be replaced by the Lessor. Lessee shall <br />accept the floor surface in an "as is" condition. However, Lessee <br />will be released from the lease obligation with no penalty if, prior <br />to each season of use when the facility floor is available for <br />inspection, it is determined by the Lessee that the floor condition <br />is such~as to be considered not suitable for tennis play. Lessor <br />will notify the Lessee when the floor is available for inspection. <br />The floor may be refinished at the option and financial obligation <br />of the Lessee. Should the Lessee choose to have the floor redone, <br />the Lessor will cooperate by allowing access to the facility for a <br />period of time mutually agreed upon. <br /> <br /> 11. Lessee is hereby allowed ingress and egress to the <br />demised premises through the Gate commonly known and referred to as <br />Gate #2 as specified on the plot plan attached (Attachment A). <br /> <br /> 12. In addition to the parking area set aside for normal <br />use (see plot plan Attachment A), the Lessor shall provide at no <br />additional cost to Lessee all necessary additional parking during <br />tennis tournaments sponsored by Lessee, subject to approval of the <br />Lessor, provided Lessee (a) notified Lessor or his assignee of the <br />proposed tournament at least thirty (30) days prior to the event, <br />(b) the additional parking will not interfere with any previously <br />scheduled event at the Fairgrounds, and (c) Lessee agrees to provide <br />necessary employees to insure parking is undertaken in a proper and <br />safe manner. <br /> <br /> 13. Lessee shall provide for maintenance and supervision <br />of the tennis facility in a safe and proper manner and provide all <br />necessary police protection. <br /> <br /> 14. Lessee is hereby granted the right to operate food <br />and beverage concessions, except alcoholic beverages, within the <br />tennis facility and to sell tennis sundries and supplies. Food and <br />beverage concession must be operated in a safe and sanitary manner, <br />subject to all requirements of the County and City health <br />departments. Lessor reserves the right to inspect and sample the <br />food and beverage services and if, in Lessor's opinion, unhealthy <br />or unwholesome food has been or is being dispenses, it may terminate <br />after forty-eight (48) hours written notice, Lessee's right to sell <br />foods and beverages. <br /> <br /> 15. In case the premises, or the building in which the <br />same are situated, are totally destroyed by any cause whatsoever <br />prior to the commencement of, or during the term of this Lease, then <br />this Lease shall thereupon immediately terminate and neither party <br />hereto shall have any further rights or be under any further <br />obligations on account of this Lease, except Lessee shall be <br /> <br /> - 3 - <br /> <br /> <br />
