6. The applicant is required to obtain written approval from State Department of Social <br />Service Community Care Licensing prior to implementing any activities that may <br />allow children being dropped off at the facility. <br />7. The applicant shall include a family restroom within the facility. The construction <br />drawings shall include the change for the review and approval by the Planning <br />Director prior to the issuance of a building permit. <br />8. Prior approval from the Planning Department must be received before any changes <br />are constituted in site design, grading, building design, building colors or materials, <br />landscape material, etc. <br />9. All exterior lighting shall be directed downward and designed or shielded so as to not <br />shine on neighboring properties. The applicant shall submit a final lighting plan, and <br />include drawings and/or manufacturer's specification sheets showing the size and <br />types light fixtures proposed for the exterior of the buildings and parking areas. The <br />light fixtures and their locations shall be subject to the review and approval of the <br />Planning Director. <br />] 0. Prior to issuance of building permits, the project developer shall provide an <br />appropriate security/ bonds for Tree No. 81 as identified in the Arborist Report <br />prepared by HortScience, Inc., dated "Received March 21, 2006." The project <br />developer shall post cash, letter of credit, or other security satisfactory to the Planning <br />Director and/or the City Attorney in the amount not less than $5,000.00 for each tree <br />should any work, utilities or otherwise, be conducted within an area in which <br />potential impacts maybe anticipated based upon the arborist report. This cash bond <br />or security shall be retained for one year following acceptance of public <br />improvements or completion of construction, whichever is later, and shall be forfeited <br />if the trees are destroyed or substantially damaged. In the event any trees are <br />destroyed or substantially damaged, the applicant shall pay to the City's Urban <br />Forestry Fund the appraised value of the said tree as stated in the arborist report, <br />prepared by HortScience, lnc., dated "Received March 21, 2006," on file in the <br />Planning Department. <br />11. The applicant shall pay to the City's Urban Forestry Fund the appraised value of the <br />trees that are to be removed for the proposed development. The appraised value is for <br />each tree as stated in the arborist report, prepared by HortScience, Inc., dated <br />"Received March 21, 2006," on file in the Planning Department. <br />12. The applicant shall follow the tree preservation measures as stated in the arborist <br />report pre and during construction. The tree protection fence shall be installed prior <br />to the issuance of a building permit. <br />13. The applicant shall enter into an agreement with the City, approved by the City <br />Attorney, which guarantees that all landscaping included in this project will be <br />maintained at all times in a manner consistent with the approved landscape plan for <br />this development. Said agreement shall run with the land for the duration of the <br />existence of the structures located on the subject property. <br />2 <br />
