EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PCUP-161, Sherman Balch, SuperFranks <br />5341 Owens Court <br />March 29, 2006 <br />The proposed use shall conform substantially to Exhibit A, the written narratives, the <br />site plan, floor plan, elevation, sign proposal, the arborist report prepared by <br />HortScience, Inc., and a letter from Community Care Licensing, dated "Received, <br />March 21, 2006," on file with the Planning Department, except as modified by the <br />following conditions of approval. Minor changes to the approved operation and <br />schedule may be approved by the Planning Director if found to be in substantial <br />compliance with the proposal. <br />The applicant shall submit a lot line adjustment applicant when this approval becomes <br />effective. The lot line adjustment shall be recorded prior to the issuance of a building <br />permit. <br />If additional hours and activities beyond what was stated in the applicant's statement <br />of operation, dated "Received March 21, 2006," on file in the Planning Department, <br />are desired, prior City review and approval is required. Such modification may be <br />approved by the Planning Director if found to be in substantial conformance with he <br />approval. The Planning Director may also refer the matter to the Planning <br />Commission if the proposed changes would be significant. <br />4. The operator of the facility shall use the following parking ratio in determining the <br />maximum occupancy capacity within the facility so that the demand for parking <br />would not exceed the 128 parking space available on site: <br />Private Party Patron: One parking space for every two patrons <br />Walk-ins, sports teams, <br />and off-peak uses: One parking space for every four patrons <br />If parking from operation of the facility becomes an issue, the applicants shall be <br />required to mitigate pazking impacts as determined by the Planning Director. Such <br />mitigations may include scaling down grouped activities. <br />If operations of this use permit results in other conflicts pertaining to noise, <br />traffic/circulation, or other factors, at the discretion of the Planning Director, this <br />conditional use permit maybe submitted to the Planning Commission for its <br />subsequent review at a public heazing. If necessary, the Planning Commission may <br />modify or add conditions of approval to mitigate such impacts or may revoke the said <br />conditional use permit approval. <br />
